1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Quests.Travel ("Company", "we", "us", or "our") governing your access to and use of the website located at quests.travel (the "Site"), including all content, features, functionality, newsletter subscriptions, and related services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree with any provision of these Terms, you must immediately discontinue use of the Services.

Quests.Travel is a B2B travel industry newsletter and content platform that provides:

  • Research-based articles and analysis on the travel and tourism industry.
  • Curated travel intelligence and industry news delivered via email newsletter.
  • Priority alerts and breaking news delivered via WhatsApp.
  • Industry surveys, reports, and interactive content.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice and without liability to you.

4. Newsletter Subscription

4.1 Subscription and Consent

By providing your name, email address, and phone/WhatsApp number and clicking the subscribe button, you expressly consent to:

  • Receive our periodic newsletter via email.
  • Receive priority alerts and breaking news via WhatsApp to the number provided.
  • Receive transactional communications related to your subscription (e.g., confirmation emails, preference changes).

4.2 Unsubscription

You may unsubscribe from our newsletter at any time by:

  • Clicking the "unsubscribe" link included at the bottom of every newsletter email.
  • Contacting us at marketing@quests.travel with the subject "Unsubscribe".

Please allow up to 48 hours for your unsubscribe request to be fully processed. Unsubscribing from the newsletter does not delete your personal data; for data deletion, please refer to our Privacy Policy.

4.3 Accuracy of Information

You agree to provide accurate, current, and complete information during registration and to maintain and update such information as necessary. We reserve the right to suspend or terminate your subscription if information provided is found to be inaccurate, fraudulent, or incomplete.

4.4 Modifications to Newsletter

We reserve the right to modify the frequency, format, content, and delivery method of the newsletter at any time without prior notice.

5. Intellectual Property Rights

5.1 Ownership

All content on the Site — including but not limited to articles, text, research, analysis, data, graphics, images, logos, trademarks, trade names, page layout, design, icons, and software — is the exclusive property of Quests.Travel or its licensors and is protected by applicable copyright, trademark, and intellectual property laws of India and international treaties.

5.2 Limited Licence

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes. This licence does not include the right to:

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services for commercial purposes without our prior written consent.

You may share brief excerpts (not exceeding 200 words) of our published articles for non-commercial purposes, provided that:

  • Proper attribution to "Quests.Travel" is clearly displayed.
  • A direct hyperlink to the original article on the Site is included.
  • The excerpt is not altered or taken out of context in a manner that misrepresents the original content.

6. User Conduct

You agree that you shall not, directly or indirectly:

  • Use the Services for any purpose that is unlawful or prohibited by these Terms or applicable law.
  • Attempt to gain unauthorised access to any part of the Services, other accounts, computer systems, or networks connected to the Services.
  • Interfere with or disrupt the integrity, performance, or security of the Services or its underlying infrastructure.
  • Use any automated system, including but not limited to bots, scrapers, spiders, crawlers, or other automated means, to access or extract content or data from the Site without our prior written consent.
  • Transmit any viruses, worms, malware, or any other code of a destructive nature.
  • Impersonate or misrepresent your affiliation with any person or entity.
  • Use the Site to transmit unsolicited commercial communications (spam).
  • Circumvent, disable, or otherwise interfere with security-related features of the Site.
  • Frame or mirror any part of the Site without our prior written consent.

Violation of any of the foregoing may result in immediate termination of your access to the Services and may expose you to civil and/or criminal liability.

THE SERVICES, INCLUDING ALL CONTENT, ARTICLES, DATA, AND INFORMATION PROVIDED THEREIN, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, we make no representation or warranty that:

  • The Services will be uninterrupted, timely, secure, or free from defects.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUESTS.TRAVEL, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, punitive, or exemplary damages.
  • Loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings.
  • Damages arising from your use of or inability to use the Services.
  • Damages arising from any content or information obtained through the Services.
  • Damages arising from unauthorised access to, or alteration of, your transmissions or data.

In any event, our total aggregate liability to you for all claims arising out of or relating to the use of the Services shall not exceed the amount, if any, paid by you to Quests.Travel during the twelve (12) months immediately preceding the event giving rise to the claim, or INR 5,000 (Indian Rupees Five Thousand), whichever is less.

The limitations set forth in this section shall apply regardless of the form of action, whether based on contract, tort (including negligence), strict liability, or any other legal or equitable theory, and whether or not we have been advised of the possibility of such damages.

9. Indemnification

You agree to defend, indemnify, and hold harmless Quests.Travel, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or in connection with:

  • Your use of or access to the Services.
  • Your violation of these Terms or any applicable law or regulation.
  • Your violation of any rights of any third party, including intellectual property rights.
  • Any content or information you submit, post, or transmit through the Services.

This indemnification obligation shall survive the termination of these Terms and your use of the Services.

10. Third-Party Links and Content

The Site may contain hyperlinks to third-party websites, services, or resources that are not owned or controlled by Quests.Travel. We have no control over, and assume no responsibility for, the content, privacy policies, practices, or availability of any third-party websites or services. Inclusion of any link does not imply endorsement, approval, or recommendation by us.

You acknowledge and agree that we shall not be liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party website or resource.

11. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately. Without limiting the foregoing, we may terminate your access if we reasonably believe that you have violated or acted inconsistently with the letter or spirit of these Terms.

Upon termination, all rights granted to you under these Terms shall immediately cease. The following sections shall survive termination: Sections 5 (Intellectual Property), 7 (Disclaimer), 8 (Limitation of Liability), 9 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution).

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government action, power failure, internet or telecommunications failure, fire, flood, or labour disputes.

13. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, including but not limited to the Indian Contract Act, 1872, the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023, without regard to conflict of law principles.

15. Dispute Resolution

15.1 Amicable Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Services, the parties shall first attempt to resolve the dispute amicably through good-faith negotiations for a period of thirty (30) days from the date of written notice of the dispute.

15.2 Exclusive Jurisdiction

If the dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India. You irrevocably consent to the personal jurisdiction and venue of the courts in Mumbai, Maharashtra, India and waive any objection based on forum non conveniens or any other basis.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Quests.Travel regarding your use of the Services and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, concerning the subject matter hereof.
